Judge evicts NYC tenant for listing rent-stabilized apartment on Airbnb

NEW YORK — A housing court judge in Manhattan has sided against a tenant who listed a rent-stabilized apartment on Airbnb.


The decision, while not the first eviction related to short-term rentals, could serve as something of a precedent for how the city's courts deal with enterprising tenants. Judge Jack Stoller found that tenant Henry Ikezi had engaged in profiteering, and awarded possession of the apartment to landlord Related Companies.



“This decision reinforces what tenant advocates and I have been saying all along — almost all NYC residents who list their homes on sites like Airbnb are violating the terms of their leases and putting themselves at risk of eviction,” said State Senator Liz Krueger, who has long voiced her opposition to illegal rentals.
